Delhi Judicial Service Association condemns day-long lawyers strike termed allegations levelled against the magistrate as"baseless"

New Delhi, Oct. 13, 2017 : The Delhi Judicial Service Association (DJSA) today condemned the day-long strike by lawyers of all the six district courts in NCR/New Delhi to protest the alleged misconduct of some judges.

The association termed the allegations levelled against the judicial officers as"baseless" and said that such act is "condemnable".

"Judges suffer in silence. Unlike other public figures, judges have no forum in which they can reply to criticism and they remain an easy target for those wishing to gain cheap publicity," Rajesh Malik, President, DJSA said in the resolution.

The Delhi Judicial Service Association (DJSA) said in a resolution condemning the strike held by lawyers of the six district courts in protest of alleged misbehaviour by a magistrate at the Tis Hazari court.

The response comes after the lawyers of all the district courts went on a strike to protest in unanimity with the lawyer who accused the judge of alleged misbehaviour.

The Delhi Judicial Service Association also said that legitimate criticism is permissible as being the exercise of the freedom of expression. But unjustified and unreasonable attacks on judicial integrity that strikes at the root of the judiciary are unacceptable.

The Delhi Judicial Service Association also added that the grievances must be raised before the appropriate forum and not by any attempt to overawe or browbeat the judicial officer to change an order and sent a copy of the resolution to the Acting Chief Justice of the Delhi High Court.

The Delhi Judicial Service Association resolution letter can be read here.

The Brief facts of the incident :

The lawyers had alleged that the incident took place on October 10 in Tis Hazari court when the magistrate, while hearing a complaint case, was requested by a junior counsel to pass over the matter as the main advocate was busy in another case.

The magistrate allegedly did not consider the request and dismissed the complaint case, they claimed.

The lawyer concerned then filed a complaint with the district judge seeking action against the magistrate.
